授業の概要・ねらい /Course Aims |
Understanding the intrinsic relationship between law and economics is essential to the analysis of economic performance. Some critics of Islam law and Islamic economics such as Max Weber argue that Islamic law is an impediment to the rise of capitalism. The argument is that law should not be founded on religion in order to separate the sacred from the secular and allow for the freedom of contract in secular economies. In fact, Islamic law made the earlier contributions to capital markets through the commenda contracts “ad risicum et fortunam” advanced by Muslim merchants in medieval Venice. These legal agreements introduce the concept of risk-sharing and presents the foundations of venture capital and equity markets. Thus, a good understanding of Islamic law of transactions is essential to comprehend the foundations of risk-sharing and also have implications for the design of Islamic financial instruments and banking services. This legal knowledge can be also useful in better appreciating the contributions of Islamic law to economic development and the history of economic thought. |

到達目標 /Course Objectives |
Students are expected to improve their essential knowledge about the principles underlying Islamic law of transactions and critical skills needed for the development of knowledgeable human resources for the Japanese finance and banking industry, including: 1. fundamental knowledge and understanding of the principles of Islamic law of transactions, 2. essential understanding of the importance of the relation between law and economics, and 3. critical analysis of the role of risk sharing in the design of Islamic finance and banking services |
